These Terms of Service govern access to and use of the WorkersFromAsia platform. Please read them carefully before registering an account.

1. Acceptance of Terms

By registering an account or accessing any part of the WorkersFromAsia platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the platform. These Terms apply to all user types: employers and individual candidates.

2. Platform Description

WorkersFromAsia is a recruitment company that facilitates the lawful, ILO-compliant recruitment and placement of skilled tradespeople from Asia (Philippines, India, Vietnam, Indonesia and others) to employers in Europe. The platform provides tools for job posting, candidate management, and supply-chain pipeline tracking, with sourcing and verification handled by our recruitment team.

3. Employer Terms

3.1 Employers may post job listings on the platform at no cost. There is no subscription fee. 3.2 WorkersFromAsia charges employers 8% of the worker's hourly bill rate, billed only once a worker is confirmed and commences employment. This fee is agreed in a separate Service Agreement before the job is published. 3.3 Employers agree not to misrepresent the job role, working conditions, salary, or housing provisions in job listings. 3.4 Employers are responsible for ensuring all employment contracts comply with the labour law of the destination country, including minimum wage obligations, working time regulations, and health and safety requirements. 3.5 Employers agree not to charge, deduct, or recover any fees from workers at any stage.

4. Our Recruitment Standards

4.1 WorkersFromAsia operates its own in-country recruitment team. We source, screen, and independently verify every candidate before their profile is presented to employers — including identity, trade certificates, and prior employment references. 4.2 WorkersFromAsia operates in full compliance with the ILO General Principles and Operational Guidelines for Fair Recruitment (ILO-GPOG), including the absolute commitment that no recruitment fees are charged to workers at any stage. 4.3 We are responsible for the accuracy of the candidate data we publish on the platform and for maintaining auditable records of each verification step. 4.4 Employers may not share platform access credentials or candidate data with third parties.

5. Candidate Terms

5.1 Candidates may never be charged any fee by WorkersFromAsia at any stage. This is a non-negotiable, permanent platform rule. 5.2 Candidates are responsible for the accuracy of the information in their profiles, including qualifications, experience, and document status. 5.3 Candidates consent to their profile data being shared with employers via the platform for the purpose of recruitment matching. 5.4 Candidates may request deletion of their profile and all associated data at any time by contacting info@WorkersFromAsia.com.

6. Prohibited Conduct

Users may not: — Submit false, misleading, or fraudulent information. — Circumvent the platform by directly engaging workers or employers outside the platform after an initial introduction via WorkersFromAsia. — Harvest, scrape, or systematically copy platform content. — Use the platform for any purpose that violates applicable law, including immigration fraud, human trafficking, or forced labour. Violation of these prohibitions may result in immediate account termination and legal action.

7. Intellectual Property

All platform content, software, and design elements are the property of WorkersFromAsia or its licensors. Users may not reproduce, distribute, or create derivative works without express written permission. User-submitted content (such as job listings and company descriptions) remains the property of the submitting party. By submitting content, you grant WorkersFromAsia a non-exclusive licence to display and process that content for the purpose of operating the platform.

8. Limitation of Liability

WorkersFromAsia acts as a recruitment intermediary and is not the employer or co-employer of any placed worker. While we independently verify candidate credentials, we do not guarantee the success of any placement or the outcome of any visa application. To the maximum extent permitted by law, our total liability arising from or related to the platform shall not exceed the total fees paid by the employer in the three months preceding the claim giving rise to the liability.

9. Governing Law

These Terms are governed by the laws of the European Union and, where applicable, the laws of Germany. Any dispute shall be resolved by the competent courts of the EU member state in which WorkersFromAsia is registered.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms. Last updated: March 2025.
